MR. LOPE: This was in April.. I didn't
• 2 follow up on it further after.
h1R. BARRY: Where I was going with my
question is could you characterize the degree of
diligence exercised by P1r. Webster or his estate or
his decedents or his heirs in moving toward a permit
on the Tennessee Pass pit?
$ MR. LOYE: They knew about the permitting
requirement for sure as of January. I went up in August
to inspect the pit precisely because I was getting
nowhere with getting them to come in caith a permit. I
was not aware of all the details of the Estate, but
• 13 quite frankly, as of August, I had no cooperation, so
I went up to find the other pit and bring them both in.
MR. I'ATTOR: I think that what the decedelit
knew, of course, died with him. He knew in January based
upon his conversations with Mr. Loye as to what he had
to do and Mr. Loye had no communication with the Estate,
not that it is his responsibility to, but we caeren't
shirking any responsibility and we didn't know until
the notice of tt~e last hearing by correspondence with
Mr. Loye a month ago that the permits Caere required
and since then, of course, it has been done.
PIS. WINTER: It sounds as though in April
•
someone knew because this was when the conversation was.
Nl.EE~ (-IRPF. ~'TEk ,V :I SS UI l.a Tf.
