<br />15 DECEMBER 1988: Colorado Mined Land Reclamation <br />Division (CMLRD) Limited Impact (110) Permit (M-88-101) for <br />9.9 acres approved. Objections were made against the oper- <br />ation by adjacent landowners. <br />TERMS OF THE ORIGINAL PERMIT: <br />a. The CMLRD review did not attempt to unravel <br />-activities of the mine which occurred prior to <br />the 1988 submittal. <br />b. The original permit acknowledges erosion <br />potential of the site and includes creation of <br />berms (topsoil on the east and fill on the west) <br />to protect area from sedimentation. The berm <br />was to be revegetated. Other Soil Conservation <br />Service (SCS) remedies and concerns for site <br />stabilization were detailed. <br />c. Soil was to be stockpiled and the stockpile <br />stabilized by vegetation until needed for <br />reclamation. Soil salvage was acknowledged to <br />be possibly less than that required to meet a <br />six inch resoil depth, and soil import was an <br />admitted possibility. The permit lacked an <br />adequate treatment on soil testing, organic <br />matter, revegetation and other stability <br />measures, even noting a good SCS report. The <br />SCS report should have been used as a foundation <br />to support a more detailed and professional <br />treatment of stabilizing and revegetating <br />drastically disturbed lands. <br />d. The access road was revealled in the permit, <br />however, the later Technical Revision indicates <br />it was not included in the permitted acreage <br />under the original permit. Placement of the <br />access road in the drainage was in response to <br />pressure from the adjacent landowner. No <br />objection was made at the time by the CMLRD, nor <br />was a hydrologic or stability/design concern <br />expressed at that time. .. <br />e. Pit slopes were agreed to be 4h:ly, since the <br />County agreed to follow the reclamation plan of <br />the SCS. <br />f. No apparent anticipation of the events <br />complicating operations at this site were in the <br />CMLRD review. Additionally, the site was, to my <br />understanding, permitted prior to recent Dept. <br />of the Army, Corps. of Engineers (DA) EPA based <br />Wetland Regulations. <br />24 MAY 1989: Correspondence from James R. Taylor to the <br />Elbert County Commissioners requesting operations at Fondis <br />Mine be discontinued. Mr. Taylor argues that the stream is <br />Correspondence of 6/15/91 to Frank G.
