<br />since it yields long term benefits to the management of the <br />site, assuming it's expanded, <br />CONCLUSIONS: <br />1. Brief Thomas Clark, Elbert County Attorney, to allow <br />him to oversee and direct decisions as they may affect the <br />legal and financial health of Elbert County. <br />2. Pending the recommendations of, and in consultation <br />with, T. Clark, contact the CMLRD over the event, and the <br />DA. Request an inspection and assistance in corrective ac- <br />tion. Don't go empty handed, but with a Technical Revision <br />that challenges past agreements and offers preferred and <br />well justified alternatives for the CMLRD and DA to respond <br />to. <br />POSSIBLE TECHNICAL REVISION COMPONENTS; <br />a. Mitigation of impacted drainage by seeding and <br />planting efforts, and clean out of impacted pond for all <br />areas within one mile downstream of the mine site. <br />Eliminate plans for the use of rip rap, an unjustified <br />waste of time and money. Utilize the assistance of the <br />Colorado Division of Wildlife to verify impacts to wildlife <br />and validate improved remedies outlined in the whole <br />Technical Revision, <br />b. Eliminate perched access road design & access <br />crossing. Replace with ground level compacted road and <br />streambed crossing, Utilize aggregate rock in streambed if <br />necessary to minimize rutting. Avoid use during wet peri- <br />ods. If snow is a concern, utilize a snow fence to protect <br />the access road. <br />c. Commence slope stability and affected land <br />revegetation. Proposed a more sophisticated soil import, <br />soil amendment, and soil stabilization plan. Establish the <br />volume of soil salvaged and stockpiled at the site, and <br />make plans to keep and maintain current soil volume <br />records. Stabilize all soil stockpiles with a suitable <br />cover of vegetation. Incorporate soil testing and analysis <br />as part of the overall revegetation/reclamation strategy. <br />Utilize a more diverse and sophisticated mix of grasses, <br />(orbs, shrubs, and trees in the revegetation plan. <br />d. Mark all permit corners and boundaries in the <br />field and confirm the integrity of affected lands with the <br />permit boundary. Sediment flows from the permit boundary <br />may be interpreted as "affected land" by the CMLRD bringing <br />to bear potentially serious permit boundary violations as <br />Correspondence of 6/15/91 to Frank G.
