This mining plan approval document is issued by the United States of America
to:
Colowyo Cosl Company
5731 State Highway 13
Meeker, Colorado 81641
for the Colowyo mine subject to the following conditions. Colowyo Coal
Company is hereinafter referred to as the lessee/operator.
Condition 1. Statutes and Regulstions.--This mining plan approval is issued
pursuant to Federal coal leases D-034365. C-35474, and C-29224;
the Mineral Leasing Act of 1920, as amended (30 U.S.C. 181 et
seg.); and in the case of acquired lands, the Mineral Leasing
Act for Acquired Lands of 1947, as amended (30 U.S.C. 351 et
seg.). This mining plea approval is subject to all applicable
regulations of the Secretary of the Interior including, but not
limited to. 30 CFR Chapter YII and 43 CFR Croup 3400, and to all
regulations of the Secretary of Energy, which are now or
hereafter in force; and all such regulations are made a part
hereof. The lessee/operator shall comply rith the provisions of
the Water Pollution Control Act (33 U.S.C. 1151 et seq.), the
Clean Air Act (42 U.S.C. 7401 et seg.) and other applicable
Federal laxs.
Condition 2. This document approves the Colowyo mine mining plan, as
modified, and authorizes coal development ar mining operations
on Federal lands within the area of mining plan approval. This
authorization is not valid beyond

Condition 3. The lessee/operator shall conduct coal development and mining
operations only as described in the complete permit application
package, updated to December 7. 1988, and approved by the
Colorado Mined Land Reclamation Division, except as otherwise
~ directed in the conditions added to this mining plan approval.
