Lxhhead <br />E>,ecurive DirMOr <br />Michael B Long <br />Division Director <br />On October 3, 1994, the Division of Minerals and Geology (DMG) received the above- <br />referenced Ten-Day Notice (TDN) from the Office of Surface Mining IOSMI, Albuquerque Field <br />Office (AFO). The TDN identifies a possible permit defect in the approved Somerset Mining <br />Company, Bear Creek portal area, reclamation plan. The plan may not fully comply with all <br />aspects of Rules 2.05.4(2)(c), 2.06.5(2), and 4.14.1(2)(a). In particular, the plan may not <br />properly demonstrate that all available spoil will be utilized in reclaiming the Bear Creek portal <br />area. Spoil placed downslope of the mine bench may not have been adequately considered for <br />use in reclamation. <br />Please provide an application for a technical revision to Permit No. C-81-022 which fully <br />complies with the above-referenced rules, and which thoroughly addresses the issue of <br />reasonably available spoil utilization. If downslope spoil is reasonably available, and can be <br />reasonably applied to reclamation of the bench area, then this must occur. <br />The technical revision application must be submitted to the DMG no later than November 14, <br />1994, and the DMG will render a proposed approval or denial decision no later than <br />January 31, 1995. Failure to have a proper plan approved by January 31, 1995 may result in <br />an enforcement action. <br />Please work with Tony Waldron regarding the required revision.
