<br />Mr. Mitchell S. Rollings <br />-2- <br />October 13, 1994 <br />Mining Company to provide a plan which fully complies with Rules 2.05.4(2)(c), 2.06.5(2) and <br />4.14.1(2)(a). This plan shall be submitted in the form of a technical revision to DMG Permit <br />No. C-81-022, and the technical revision shall be provided to the DMG no later than <br />November 14, 1994. Additionally, the DMG shall provide a proposed decision to approve or <br />deny this technical revision no later than January 31, 1995. This timeframe allows for the full <br />DMG ten-day revision completeness period, and the full DMG sixty-day review and decision <br />period. <br />We have enclosed documents, recently approved by the DMG, which are pertinent to this <br />situation. On July 7, 1994, Minor Revision No. 25 was approved, which incorporated Permit <br />No. C-81-022, page 2.06-5, and a Bureau of Land Management (BLlvn letter dated May 25, <br />1994 (now permit page 2.06-5). Additionally, on September 23, 1994, Minor Revision No. 29 <br />was approved which incorporated, in part, permit page 2.05-39. This page specifies clarification <br />regarding the post-mining land use for the Bear Creek portal area. The DMG believes that these <br />two revisions satisfy the AFO concerns regarding landowner consent and post-mining land use <br />designation. <br />A permit deficiency may still exist regarding an adequate demonstration that all reasonably <br />available spoil will be used to reclaim the Bear Creek portal area. This process will result in a <br />new evaluation of this issue. <br />Please contact us with any questions.
