ENFORCEMENT ACTIONS <br />The following identifies enforcement actions taken during this inspection, the required abatement <br />and date of abatement for the violation, previous violations still requiring abatement and the <br />termination of violations cited during previous inspections. <br />Notice of Violation C-97-O10 has been issued as a result of the observations documented in <br />Section III of [his report, regarding excavation of subsoil materials at the cut slope above the <br />Material Storage Bench without Division approval. Specifically, Notice of Violation C-97-O10 <br />is issued for: the failure to obtain regulatory approval for mine site construction activities <br />including significant excavation of previously undisturbed areas, prior to initiating construction. <br />MCC should cease all unapproved activities at this time. The Division is in receipt of Minor <br />Revision Application No. 220 which requests approval for excavation activities at the cut slope <br />above the MSB and for expansion of the MSB. The Division is currently reviewing this <br />application.
