<br />III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the <br />inspection and the facts or evidence supporting the enforcement action. <br />and repair and control of slope movement in the area of the MSB. That revision is currently <br />under review. <br />Aerial photographs taken of the MSB and cut slope above the MSB were reviewed to verify the <br />azea of disturbance and to determine if additional construction activity had occurred in this area <br />since the July 10, ]997 inspection. The aerial photographs taken on July 15, 1997 were <br />compared with aerial photographs taken on May 8, 1997. From this comparison, it is apparent <br />that a significant area of new disturbance has occurred (since May) in the cut slope above the <br />MSB. <br />Four aerial photographs were taken of the MSB and surrounding azea on the morning of July 15, <br />1997. From these photos it is appazent that conswction activity was in progress at the cut slope <br />above the MSB at the time of the photographs. Each of the photos shows a trackhoe and/or <br />backhoe and dumpwck working in the area of the subsoil excavation at the cut slope. From the <br />photos it appears that subsoil is being excavated and loaded into the dumptruck. This <br />conswction activity occurred following the July 10th inspection and prior to Division approval <br />for continued conswction activities a[ the cut slope above the MSB. <br />2 <br />
