Companies contends that there has been an understanding that certain parts of the permit <br />area were to be used for other purposes. Specifically, the office building, maintenance <br />shop building and the land surrounding them would continue to be industrial facilities." <br />The intended post mining land use for the Phase I area of M-1979-205 has not been <br />clearly stated in any of the permit documents or subsequent correspondence for this <br />Reclamation Permit. <br />At this time, United Companies proposes that the assumptions of the past concerning the <br />post-mining land use for this parcel need to be clarified, corrected and formalized. United <br />Companies requests that the approved post-mining land use for the land owned by Rocks <br />R Us LLC be changed from rangeland to industrial use. <br />mma <br />1. The requested change presents no conflict with Garfield County's Zoning <br />Resolution which classifies the land, AgriculturaUIndustrial, A/I. <br />2. The requested change presents no conflict with the character of the established <br />businesses and existing land uses in the near vicinity. The area along Highway 6 <br />contains a variety of industrial businesses. The character of the area is industrial <br />and heavy commercial. <br />The requested change recognizes the landowner's understanding and intentions <br />for post-mining land use of the site. This site has been an industrial site for at least <br />25 years. Future use of the Rocks R Us LLC parcel will most likely be an <br />industrial use. Exhibit 5 is a letter from the landowner stating satisfaction with <br />reclamation that has been done at the site. <br />United Companies believes that the highest and best use of this site is as an industrial <br />site and requests that the approved post mining land use for the site be changed to <br />industrial use. <br />2 <br />
