Dept Of Natural Resources <br />Denver, Colorado 80203 <br />Re: Blue Ribbon Coal Company; Cessation Order <br />No. 84-001, dated March 22, 1984 <br />Dear Dave: <br />On page 4 of my letter of April 17, 1984, I stated <br />Blue Ribbon's request that the referenced cessation order be <br />vacated and that the abatement period for Notice of Violation <br />No. C-047-81 be extended to March 29, 1984. In summary, the <br />rationale was that there was no "good cause" for issuance of <br />the cessation order, that Blue Ribbon had shown good cause for <br />its vacation, and that the circumstances made March 29 a <br />reasonable abatement deadline. The purposes of this letter are <br />(1) to explain how the Act allows for an abatement period <br />extension which is requested after the initial period has <br />passed and (2) to further explain the justification for such an <br />extension to March 29 in this case. <br />The first point is that the Act and regulations allow <br />the Division to extend an NOV abatement period upon request <br />made after the initial period has passed. In addition, we <br />believe that consideration of such a request is required. A <br />concomitant part of granting the extension request would be <br />vacation of any cessation order issued under C.R.S. <br />§34-33-123(3) and Rule 5.03.2(3). <br />Good cause must be shown, with a written finding to <br />that effect, to issue a cessation order for failure to abate an <br />NOV within the time originally set or as extended. C.R.S. <br />§34-33-123(3); Rule 5.03.2(3). Thereafter, the Division may <br />vacate the cessation order for good cause so long as the <br />grounds are not impossibility or an insufficient basis for the <br />inspection. C.R.S. §34-33-123(5); Rule 5.03.2(5)(b). Since <br />the identical criterion of "good cause" is used in both places, <br />both the Act and regulations clearly contemplate that the <br />'T <br />
