SCC was to <br />complete construction of sedimentation pond 016 and provide a <br />certification by a qualified registered engineer that it was <br />constructed as designed and as approved in the permit by October <br />31st <br />At the time of the inspection on September 28th, riprap was <br />being delivered and placed in the emergency spillway channel. The <br />principal spillway was already constructed and functional and the <br />pond was retaining approximately 2-3 feet of water in it as well. <br />The following construction details were all that was needed to <br />complete the overall construction of the pond, which was <br />eventually completed the following week. First, the riprap needed <br />to be shaped in the emergency spillway channel per the schedule <br />depicted on Exhibit 13-8A, Sheet 1 of 2, Pond 16 Design. Next, <br />the trash rack/anti-vortex baffle plate was placed on the <br />principal spillway pipe. Finally, all topsoil was respread on the <br />disturbed slopes and embankment down to the anticipated water <br />level and revegetated with the proper seed mix. The sedimentation <br />pond 016 construction was deemed complete by the Division, based <br />on the comments contained in Mr. James Stark's inspection report <br />dated October 17, 2000. <br />To the best of my knowledge, based upon my professional <br />expertise, and to the extent possible, sedimentation pond 016 at <br />the Seneca II-W Mine was constructed in accordance with the <br />prudent state-of-the-art methods for earthen embankment <br />construction. Further, the structure was constructed in <br />compliance with the approved design, to the extent possible, as <br />specified in Attachment 13-SB of Seneca Coal Company's approved <br />mine permit. Minor field adjustments in horizontal and vertical <br />alignment were necessary during construction to compensate for <br />unanticipated natural conditions, limit the disturbed area, and <br />construct a structure consistent with the existing and reclaimed <br />topography. <br />~x X70 <br />Seneca Ccal Company • P.O.
