URIE, Urie Ranch, Eox 25, Maybell, Colorado 81640 (Grantor), <br />as owner of certain land described as r"ollows: <br />TOWNSY,IP 6 NORTY., RAAlGE 95 [JEST OF THE 6TH P.M., M.^FFAT COUNTY, COLORADO <br />Section 9: E 1/2 <br />for the consideration of $10.00 and other good and valuable consideration, the <br />receipt of which is hereby acla?owledged, do hereby grant, bargain, sell and <br />convey to MOFFAT LIMESTONE COMPANY, a Colorado corporation, (Grantee), Maybell, <br />Colorado the following: <br />A perpetual non-exclusive easement and right-of-way over, across, and <br />through the above described real property and being fifty feet in <br />width. Said easement and right-of-wa/ shall commence at the existing <br />highway fence bordering Moffat Co~.u~ty highway 57 in the E1/2 of Secticn <br />9, T6N, R954J of the 6th P.M., N,affat County, Colorado; thence easterly <br />A the boundary of the W1/2 of Section 10, T6N, R951^1 of the 6th P.M.; <br />Moffat County, Colorado. <br />Said easement and right-ow-;ray shall be for the purposes of access, ingress <br />and egress by Grantee, its agents, employees, business invitees and others having <br />business with Grantee to Grantee's mining claims, mining operations, 1=_ases <br />or other properties of Grantee described hereafter. It shall be for the flu^ther <br />use of Grantee, its agents, employees, and business invitees W haul, truck, ship, <br />market and transport limestone and other products that may be produced by <br />Grantee and for all other business purposes to and from irantee's mining claims, <br />mining operations or other properties to U.S. Highway 40 or ether public roads. <br />Grantee shall have the right to build, grade, cut, improve and maintain <br />a roadway on the said easement and right-of-way and to use so much of the <br />surface and surface material as is necessary for such proposes. Grantor and <br />Grantee shall mutually pick the route for the easement and nigh*,-of-ar y and <br />shall jointly stake t'~e same. Should Granter not par*_icipate in this selection <br />ar_d staking process with Grantee, then Cran~.ee shall se?.ect and stake the route <br />and in_*'orm Grantor of the same prior to comaencirg work en the road. <br />This easement and right-of-way if for the benefit of and appur*.enant to <br />that land or any portion thereof ueor. a~hich Grantee holds or leases miring <br />claims or has mining operations described as follows: <br />See Exhibit A attached hereto and incorrorated herein by this reference. <br />Grantor and Grantee flmther agree to the following terms for operation. <br />on said ease.~nent and right-of-wav: <br />
