BEFORE THE MINED LAND RECLAMATION BOARD <br />STATE OF COLORADO <br />FINDINGS OF FACT, CONCLUSIONS OF LAW AND ORDER <br />IN THE MATTER OF THE AMENDMENT APPLICATION OF VARRA COMPANLES, <br />INC., OVER OBJECTIONS, FILE NUMBER M-1978-056 <br />THIS MATTER came before the Mined Land Reclamation Board ("Boazd"} on <br />October 27, 2004, in Denver, Colorado for a hearing to consider the Section 112 <br />Construction Materials Amendment Application of Varra Companies, Inc. ("Applicant"). <br />The file number for this matter is M-1978-056. Bradford Janes appeared on behalf of the <br />Applicant. Michael D. Bliss appeared on behalf of Bliss Produce Company ("Objector"). <br />Tom Schreiner and Steve Brown appeared on behalf of the Division ofMinerals and <br />Geology ("Division"). <br />The Board, having considered the parties' presentations and having been otherwise fully <br />informed of the facts in this matter, hereby enters the following findings of fact, conclusions of <br />law and order: <br />1. The Applicant intends to extract sand and gravel from a site adjacent to the Cache la <br />Poudre River east of Greeley, Colorado. The site of the proposed mining activity is in the <br />northwest quarter of the northwest quarter of Section 10, Township 5 North, Range 65 <br />West, 6~h Prime Meridian, Weld County, Colorado. The site is approximately 229.89 <br />acres. The site, known as the Durham Pit, was originally permitted in 1978 and has been <br />mined over the course of the last 30 years. The Durham Pit will be reclaimed to <br />industriaUcominercial use along with two unlined ponds of 128 and 7 acres in size. <br />Z. The Applicant submitted a complete amendment application on November 13, 2003. The <br />purpose of the amendment applicaton was to update the mining and reclamation plan for <br />
