EXHIBIT S MAN-MADE STRUCTURES -.[Rules & Regs §6.4.19] CONSTRUCTION MATERIAL FILE N-O M 1983 -208 REGULAR 112 OPERATION NW'/~ SEC 11, T48N~ R10W ~SHAVANO GRAVEL" January 2002 - 112 Corrversion (Revised 12 July 02) Manmade structures within 200 feet ofthe permit operations aze the following. 1. Shavano Cemetarv, on property of the applicant/owner County of Montrose, bounds a portion of the east~entral permit boundary. A 25-foot setback from that beundazy for this site's operations satifies requirements of Montrose County Zoning Resolution Section XII-1-b-(1). Montrose County shall take special precautions of erecting barricades at the setback line to prevent accidental trespass and damage to the cemetary. The no-steeper-than 3-horizontal to 1-vertical (3-H:1-V) design of the excavated sideslopes is, by engineering evaluation, known to be adequately stable against accidental sloughing, as demonstrated by the Caterpillaz Performance Handbook 31 ~` Ed. listing of the maximum angle of repose range for loose pit-run "round to angulaz gravel" as from 1.7-H - 0.9-H to 1-V. The specified 3:1 slopes are so much shallower, thus within a liberal cushion of stability. 2. Boundary Fences owned by the County of Montrose applicant are at the west, north, and north half of the east property beundazies at 25 feet or greater from excavation, and other mining operations, and at the southwest boundary at Populaz Road. In the unlikely event of damage to that structure as a result of mining operations the Applicant/Operator, Montrose County, agrees to repair the damage to its own fences. 3. Paved County Road -- Populaz Road, owned by County of Montrose, is withn 200 feet of the alternate access road mute at the southwest corner of the site. There aze no immediate pains for developing that alternate access route, however, in the unlikely event of damage to the county road caused by the proposed operations in that vicinity, the Applicant/Operator, Montrose County, agrees to repair the damage to its own road 4. Power Transmission Line, located off the mesa to the northeast is greater than 200 feet from any mining and processing activity at the site or access road thereto. Another overhead powerline, belonging to Delta Montrose Electric Association lies on the northeast right-of--way line of Populaz Road. A damage reimbursement agreement with Delta Montrose Electric Association has been executed in case of damage to that structure caused by the proposed operations. A copy of that agreement, completed 31 May 2002 follows. 5. Residence belonging to Susan & Kevin Asnicaz lies between the southwest corner and Populaz Road. A damage reimbursement agreement with the Asnicazs has been executed in case of the unlikely event of damage to that structure caused by the proposed operations. A copy of that agreement, completed 31 May 2002, follows. 6. Driveway. Shed, & Fences of the Midwest Coloazado Mental Health Center facility located southeast of the future southwest alternate access. A damage reimbursement agreement with Midwest Coloazado Mental Health Center has been executed in case of the unlikely event of 37
