EXHIBIT S <br />MAN-MADE STRUCTURES <br />-.[Rules & Regs §6.4.19] <br />CONSTRUCTION MATERIAL FILE N-O M 1983 -208 <br />REGULAR 112 OPERATION NW'/~ SEC 11, T48N~ R10W <br />~SHAVANO GRAVEL" <br />January 2002 - 112 Corrversion (Revised 12 July 02) <br />Manmade structures within 200 feet ofthe permit operations aze the following. <br />1. Shavano Cemetarv, on property of the applicant/owner County of Montrose, bounds a portion of <br />the east~entral permit boundary. A 25-foot setback from that beundazy for this site's operations <br />satifies requirements of Montrose County Zoning Resolution Section XII-1-b-(1). Montrose <br />County shall take special precautions of erecting barricades at the setback line to prevent <br />accidental trespass and damage to the cemetary. The no-steeper-than 3-horizontal to 1-vertical <br />(3-H:1-V) design of the excavated sideslopes is, by engineering evaluation, known to be <br />adequately stable against accidental sloughing, as demonstrated by the Caterpillaz Performance <br />Handbook 31 ~` Ed. listing of the maximum angle of repose range for loose pit-run "round to <br />angulaz gravel" as from 1.7-H - 0.9-H to 1-V. The specified 3:1 slopes are so much shallower, <br />thus within a liberal cushion of stability. <br />2. Boundary Fences owned by the County of Montrose applicant are at the west, north, and north <br />half of the east property beundazies at 25 feet or greater from excavation, and other mining <br />operations, and at the southwest boundary at Populaz Road. In the unlikely event of damage to <br />that structure as a result of mining operations the Applicant/Operator, Montrose County, agrees <br />to repair the damage to its own fences. <br />3. Paved County Road -- Populaz Road, owned by County of Montrose, is withn 200 feet of the <br />alternate access road mute at the southwest corner of the site. There aze no immediate pains for <br />developing that alternate access route, however, in the unlikely event of damage to the county <br />road caused by the proposed operations in that vicinity, the Applicant/Operator, Montrose <br />County, agrees to repair the damage to its own road <br />4. Power Transmission Line, located off the mesa to the northeast is greater than 200 feet from any <br />mining and processing activity at the site or access road thereto. Another overhead powerline, <br />belonging to Delta Montrose Electric Association lies on the northeast right-of--way line of <br />Populaz Road. A damage reimbursement agreement with Delta Montrose Electric Association <br />has been executed in case of damage to that structure caused by the proposed operations. A copy <br />of that agreement, completed 31 May 2002 follows. <br />5. Residence belonging to Susan & Kevin Asnicaz lies between the southwest corner and Populaz <br />Road. A damage reimbursement agreement with the Asnicazs has been executed in case of the <br />unlikely event of damage to that structure caused by the proposed operations. A copy of that <br />agreement, completed 31 May 2002, follows. <br />6. Driveway. Shed, & Fences of the Midwest Coloazado Mental Health Center facility located <br />southeast of the future southwest alternate access. A damage reimbursement agreement with <br />Midwest Coloazado Mental Health Center has been executed in case of the unlikely event of <br />37 <br />
