~~ <br />i~ <br />i~ <br />i~ <br />j <br /> <br /> <br />1 would decide to grant the amendment, I think we should <br />2 make Castle's waiver quite explicit. i'ou may remember <br />3 back in June, Castle argued that this board had no <br />4 jurisdiction to consider this matter after 120 days, and <br />5 after 120 days, your approval was automatic in case law <br />6 in Colorado, and it cited that law to you. <br />7 It is my understanding from conversations <br />8 with Mr. Briggs before the hearing that they are willing <br />9 to stipulate that while they reserve the objection as to <br />10 the June continuance, which they opposed, they are <br />11 willing to waive any new defenses that might be brought <br />12 up by any continuances today. <br />13 So in summary, we think the board should <br />14 not grant the continuance. We think that that avoidance <br />15 technique will not been effective but that the avoidance <br />17 <br />16 could be cured by mere replacement of promises by not <br />17 performing on the corrective action plan, which may take <br />18 longer than next spring. <br />19 And, finally, if the board does find--is <br />20 inclined to grant the motion for continuance, we should <br />21 make Castle aware of any new defense by this motion quite <br />22 explicit.
