The board found a violation. <br />3 Castle has now given this board a new <br />4 promise in the form of a corrective action plan, but <br />5 hundreds of materials are still off-site but notY~ing has <br />6 been done except for presenting a promise to the board. <br />7 The board knew there was a promise not to do this;, and <br />8 there were off-site rocks. <br />16 <br />9 Now that the board has found a violation, <br />10 the status quo today is that there's another promise from <br />11 Castle and hundreds of tons of off-site rocks. ]: don't <br />12 think that this board can find that the violation has <br />13 been cured by replacing an old broken promise with a new <br />14 one that hadn't been repaired yet or hadn't been <br />I5 performed. So even if this board would choose to ignore <br />16 the mandates of the legislature by granting the <br />17 continuance so that you could consider the permit: <br />18 application after you may want to deem the violation <br />19 cured by spending new promises, I don't think that's <br />20 going to get the board home, and you ought to ju~;t bite <br />21 the bullet today and deny the motion to continue and <br />22 consider the amendment in the proper context today. <br />23 Nothing has changed.
