(g) Lessee shall provide Lessor a copy of any allegation made against Lessee <br />regarding the mining operation conducted pursuant to this lease, and a copy of any allegation <br />made against Lessee that it has violated the terms of any license or permits held by Lessee for <br />mining operations in Pueblo County. <br />11. Taxes and Encumbrances. <br />(a) Lessee shalt be responsible for and pay when due any mineral production <br />tax and any tax assessed against the personal property, improvements or fixtures hereafter placed <br />on the Property by Lessee and any increase in property taxes that directly result from <br />improvements or change to the Property at the instance of Lessee's operations thereon pursuant <br />to the terms of this Lease. Notwithstanding the foregoing, Lessor shall be responsible for <br />property and other taxes assessed against the Property which accrue during the term of this Lease. <br />(b) Each party (the "Paying Party") shall have the right, but not the obligation, <br />at any time to pay on behalf of the other party (the "Defaulting Party") any tax or to satisfy and <br />remove any lien on the Property in the event of default of payment or other obligation by the <br />Defaulting Party and the Paying Party shall be entitled to reimbursement of amounts paid <br />together with an interest charge at the rate of 12% per annum or the highest rate allowed bylaw, <br />whichever is less, which amounts, including amounts for interest shall be added to any amounts <br />of money payable to Paying Party or deducted from any amounts of money payable to Defaulting <br />Party under the terms hereof. <br />12. Indemnification. <br />(a} Indemnification by Lessee.
