permits, bonds, orders and required govemmental consents pertaining to mining operations, <br />mined land reclamation, local ]and use regulation, and environmental regulation and control. <br />Lessee shall be deemed to be in compliance with governmental regulations and orders while <br />Lessee is contesting any alleged or cited noncompliance in good faith in circumstances in which <br />Lessor's interest is not jeopardized. <br />(c) The Royalty set forth above shall be deemed full payment to Lessor for <br />any damages to the surface of the Property or the Leased Strata which may be caused by Lessee's <br />operations hereunder, if and so long as Lessee conducts its operations in a reasonable and prudent <br />manner, in compliance with all applicable governing agencies, and reasonably maintains the <br />plant site improvements on the Property. <br />(d) If this Lease is terminated for any reason, subject to payment of royalties, <br />Lessee may remove all stockpiled Minerals from the Property within twelve (12) months after <br />such tetmination. All such items not removed within twelve months shall, at Lessor's option, <br />become the property of Lessor. <br />(e) Lessor shall take no action, directly or indirectly, which would cause or <br />encourage the loss of restriction of Lessee's right under applicable governmental regulations to <br />mine and remove Minerals from the Property in the maximum quantity available from the <br />Property, provided that this subparagraph shall not limit Lessor's right to terminate this Lease for <br />default. <br />(f) Lessee shall permit Lessor to review copies of all received licenses and <br />permits allowing the mining operation conducted pursuant to this lease, and shall permit Lessor <br />to make copies of any such license or permit at Lessor's sole expense. <br />t:\legal\wkakmccpueblo\Iease.Jw g y 7(~/a/ <br />
