Identification of present <br />and future topsoil resources on site will be performed eazly in the season to <br />integrate this information into the mining and reclamation plan. Topsoil <br />considerations will be given #2 priority for 2005 field activities. <br />3) Land ownership and claims boundaries for this specific azea have proven to be <br />quite complex and difficult to accurately discern as to the ]ocadon(s) of Points of <br />Beginning for the numerous surveys which have been performed in the close <br />proximity of the mining azea. Referring to the map file copy attached to this <br />request, please note that until the Division performed their GPS survey of affected <br />land azea in late 2004, no survey has been performed in this azea since the eazly <br />1900's, leading to discrepancies between BLM mining claims records, USFS <br />boundary maps, and Chaffee County tax records that cammot be rectified without <br />on-the- ground survey control and follow-up adjustments regazding neighboring <br />land azeas, if necessary, to.comply with Colorado-Mining Law regazding proof of <br />right to enter all azeas within the scope of the affected land boundazies. Phis will <br />entail survey time in the field and office and follow-up work related to mining <br />claims and/or ]easing negotiations as needed to comply with Mining Law and <br />USFS regulations regazding mining operations on federal lands. It is expected <br />that these issues could greatly increase the time needed to develop an adequate <br />conversion package. <br />4) Once all issues regazding DMG concerns of site environmental control are <br />addressed by design, approved by DMG staff, and installed on site, it is requested <br />that mining proceed for the 2005 field season only within the original boundaries <br />of the 110 type permit azea. This means that mining and waste removal will occur <br />only within those azeas under present permit. This does not include any areas <br />currently disturbed but outside present pemut boundaries, within the exception of <br />environmental control structures such as diversions, sediment fences, sediment <br />control ponds, or other structures determined to be necessary and reasonable to <br />maintain control of sedimentation off-site. Mining will be restricted to that zone <br />in the pit area shown as the "Exchequer" claim, a ten acre lode claim located <br />central to the mining disturbance. No further disturbance of lands outside the <br />original 10 acre permit boundary will be entertained until a 112 type conversion <br />permit is approved and in place. <br />5) Bond has been increased on the site from originally $ I SK to $300,000 to reflect <br />adequate surety for level of site disturbance at this time. This bond has been <br />posted by Colorado Marble LLC. <br />6) Colorado Mazble will file a monthly report, including photos, with the Division to <br />keep them abreast of conditions at the site and the status of erosion control and <br />sedimentation control structures' performance. These monthly condition reports <br />will be continued until a complete conversion package is received by DMG staff. <br />Thank you for your consideration of this extension request. Colorado Mazble is <br />committed to proceed with all efforts to maintain environmental control at the site and <br />complete a conversion package in as timely a fashion as is possible. <br />
