A <br />review of the submitted information has found the request to be incomplete. <br />• The minor revision request should be resubmitted with the following <br />information and changes. <br />I. Incidental Boundary Change <br />1) The incidental permit boundary changes do not seem to be <br />appropriate for this activity. At the New Elk Mine, a 450 foot <br />shift is proposed. The existing access road to the river, which <br />has previously been used for culvert maintenance, is less than <br />100 feet from the existing boundary. The Division feels that <br />there is no need to extend the permit boundary further than the <br />existing access road. <br />The boundary changes at the Golden Eagle mine also seem to be <br />larger than necessary. It was stated in a phone conversation <br />with Candace Thompson that the large area upstream of the <br />culvert was necessary for access due to steep slopes near the <br />culvert. Notwithstanding, Attachment 2 submitted with the <br />revision indicates that the western extent of the proposed <br />boundary can be decreased by at least 100 feet. The access <br />route should be included on the map to substantiate the need for <br />the specific boundary location change requested. Also, the <br />Division does not feel that the downstream boundary change is <br />necessary, as there is no evidence of deposition in this area. <br />• Any questions of access rights to the proposed entry point <br />should also be addressed. <br />423 Centennial Building, 1313 Sherman Street Denver, Colorado 60203 Tel.
