-z- CEASE AND DESIST ORDER Based upon these same Findings of Fact and Notice of Violation, and in accordance with C.R.S. 34-32-124(2), (6) and (7), the Colorado Mined Land Reclamation Board hereby orders Gold Hill Ventures and Colina Oro Molino, Inc. to: Cease and desist from conducting the following mining and milling operations at the Cash (Gold Hill) Mill and Mine - Permit M-63-141: Cease and desist from mining and milling at the site until all corrective actions have been completed to the satisfaction of the Division by 5:00 p.m. on 6/23/92. 2. Mail, within one (1) day after receipt of this Notice, to the Mined Land Reclamation Board, written notice of your compliance with paragraph one (1) of this Cease and Desist Order. 3. Complete the following corrective action: (a) Submit a detailed plan to the Division which describes the proposed measures to be employed to prevent future spills and insure containment in the pond. Include a map with the location of all monitor wells on the permit area and downgradient from the tailings pond and all water monitoring data collected from these wells over the last year. Include in the plan a water level and water monitoring scheme for current monitor wells, ponds, adits and underground workings. This plan must be submitted by 5:00 p.m. on 6/23/92. (b) Submit an amendment to the Division which adds acreage to the permit, that includes areas disturbed outside the permit boundary and areas where water or tailings are conveyed, by 5:00 p.m. on 6/23/92. 4. Pay the Colorado Mined Land Reclamation Board a civil penalty in the amount of 44,200.00 within 30 days of the signature date of this document. This is based upon an assessment of 5100.00 per day for 42 days of violation from 2/13/42 to 3/26/92, additional civil penalties may he assessed from 3/26/92 if the corrective actions are not completed by 5:00 p.m. on 6/23/92. This Cease and Cesist Order ;hall remain in effect until all terms have been satisfied by the operator. In clarification of the rights of recipients of Notices of Violation, Cease and Desist Orders, parties are advised to consult the Colorado Mined Land Reclamation Act and the State Administrative Procedure ACL. Nothing herein contained, particularly those portions requiring certain acts to be performed within a certain time, Shall be construed as a permit or license to engage in any prospecting or mining operations within the State.
