<br />STATE OF COLORADO <br />MINED LAND RECLAMATION BOARD <br /> <br />DEPARTMENT OF NATURAL RESOURCES <br />IN THE MATTER OF: Gold Hill Ventures ) NOTICE OF VIOLATION M-92-030 <br />and ) AND <br />Colina Oro Molino, Inc.) CEASE AND DESIST ORDER <br />T0: Gold Hill Ventures and Colina Oro Molino, Inc., and all other persons <br />engaged in or owning or Controlling the following operation: Cash Mine and <br />Mill, Boulder County. <br />FINDINGS OF FACT <br />Pursuant to the authority vested in the State of Colorado Mined Land <br />Reclamation Board by C.R.S. 34-32-124, the Board hereby makes the following <br />findings of fact: <br />Gold Hill Ventures and Colina Oro Molino, Inc., is permitted to conduct >_ <br />mining and milling operation under the terms of Permit M-83-141 locates <br />in Section 12, Township 1 North, Range 72 West of the 6th P.M., in <br />Boulder County, Colorado. <br />2. The Mined land Reclamation Board conducted a Formal Puhlic Hearing on <br />May 28, 1992 to consider possible violation of the terms of Permit <br />M-83-141 and C.R.S. 34-32-101 et sea. <br />3. The Mined Land Reclamation Division presented evidence at the Formal <br />Public Hearing on May 28, 1992, demonstrating that: <br />(a) Mine tailings have been spilled on the ground both on site and off <br />site from the Cash (Gold Hill) mill building, the tailings pond and <br />pipes leading to and from the tailings pond. <br />(b) The spilled tailings were not completely cleaned up by the <br />Division's 5/22/92 inspection. <br />NOTICE OF VIOLATION <br />Based upon these same findings of Fact and in accordance with C.R.S. <br />3a-32-124(6), the Colorado Mined Land Reclamation Board hereby finds Gold Hill <br />Ventures and Colina Oro Molino, Inc., to be in violation of Permit M-83-141 <br />and C.R.S. 34-32-116(7)(c) and (d). <br />
