-F ~ -2- CEASE AND DESIST ORDER Based upon these same Findings of Fact and Notice of Violation, and in accordance with C.R.S. 34-32-124(2),(6) and (7) the Colorado Mined land Reclamation Board hereby orders Gold Hill Ventures and Colina Oro Molino Inc. to: Mail, within one (1) day after receipt of this Notice, to the Mined Land Reclamation board, written notice of your compliance with paragraph one (1> of this Cease and Desist Order. 2. Complete the following corrective action: (1) Provide the Division with a copy of the vacuum test results for all patches made on the liner by 5:00 p.m. on 6/23/92. (Z) Provide the Division ~nith an adequate monitoring plan to assure no rips or holes occur again. Provide the plan by 5:00 p.m. on 6/23/92. 3. Pay the Colorado Mined Land Reclamation Board a civil penalty in the amount of 31,000.00, within 30 days of the signature date of this document. This is based upon an assessment of 3165.00 per day for 123 days or violation, from 11/26/92 to 3/26/92, with 319,295.00 suspended, lea-canp~et-ion~~the-corrective action-out/-fined-in this or-der. This Cease and Desist Order shall remain in effect until all terms have been satisfied by the operator. In clarification of the rights of recipients of Notices of Violation, Cease and Desist Orders, parties are advised to ccnsult the Colorado Mined Land Reclamation ,act and the State Administrative Procedure Act. Nothing herein contained, particularly those portions requiring certain acts to be performed within a certain time, shall be construed as a permit or license to engage in any prospecting or mining operations within the State. Persons concerned Edith judicial review of the provisions of this Order are advised to consult C.R.S. 24-4-106, as amended. Dated at Denver this 1st day of June, 1992.
