<br />STATE OF COLORADO <br />MINED LAND RECLAMATION BOARD <br />DEPARTMENT OF NATURAL RESOURCES <br />IN THE MATTER OF: ) NOTICE OF VIOLATION M-92-028 <br />Gold Hill Ventures and ) AND <br />Colina Oro Molino Inc. ) CEASE AND DESIST ORDER <br />T0: Gold Hill Ventures and Colina Oro Molino Inc. and all other persons <br />engaged in or owning or Controlling the following operation: Cash Mine <br />and Mill, Boulder County. <br />FINDINGS OF FACT <br />Pursuant to the authority vested in the State of Colorado Mined Land <br />Reclamation Board by C.R.S. 34-32-124, the Board hereby makes the following <br />findings of fact: <br />1. Gold Hill ';e-tures and Colina Oro Molino, Inc. is permitted to conduct a <br />mining an= ...'sling operation under the terms of Permit M-83-141 located <br />in Boulder ~:ounty, Section 12, Township 1N, Range 72W of the 6th P.M., in <br />Boulder Cou^ty, Colorado. <br />2. The Mined Land Reclamation Board conducted a Formal Public Hearing on <br />May 28, 1992 to consider possible violation of the terms of Permit <br />M-83-141 and C.R.S. 3a-32-101 et sea. <br />3. The Mined Land Reclamation Division presented evident= at the Formal <br />Public Hearing en May 28, 1992, demonstrating that: <br />1. Numerous rips and holes occur in the tailings pcnd liner. <br />2. All rips and hoses were patched by the Divison's 5/22/92 inspection <br />using the approved e:etrusion welder method. All patches were vacuum <br />tested. The co-permittees will send a copy of the vacuum test report <br />to the Division when it is received. <br />NOTICE OF VIOLATION <br />Based upon these same Findings of Fact and in accordance with <br />C.R.S. 34-32-124(6), the Colorado Mined Land Reclamation Board hereby finds <br />Gold Hill Ventures and Colina Oro Molino, Inc. to be in violation of Permit <br />M-83-141, and C.R.S. 34-32-116(7)(c) and (d). <br />
