~ '^ "'~(, <br />- From aerial photographs reviewed in the State files and the <br />observations recorded in a DNR inspection report, dated <br />5/3/95, it will be necessary to remove and bury sediment <br />from the lower diversion as part of the backfilling <br />operation. What are the disposal plans for the diversion <br />material? <br />- State Rule 2.05.6(6) requires a subsidence survey, <br />subsidence monitoring, and subsidence control plan. Little <br />information was found in the permit that addressed <br />subsidence. The only place found in the permit that <br />discussed subsidence effects was the paragraph of item 5, <br />page 14, which stated simply that "subsidence expressions", <br />including eroding gullies, will be backfilled and graded to <br />eliminate depressions. It is not clear whether this <br />reclamation will prevent a lessening of the land use should <br />additional subsidence occur in the future, which is a <br />finding required by State Rule 2.05.6(6)(f)(iii) Has such a <br />determination been made? <br />A special concern was raised by the landowner (John Walsh) <br />regarding the ground cracking along the fence line to the <br />west of the mine entrance. (See the 10/16/95 State <br />inspection report C-80-002.) The inspector speculated that <br />to fix the subsidence effects, part of the fence would have <br />to be temporarily removed to permit backfilling and grading <br />of the area. The mine operator (Mr. Weaver) was to perform <br />this work by November 1, 1995. No information was found in <br />the permit that indicated the work had been completed. If <br />the work has not been completed, will the DNR reclamation <br />plan include the subsidence repairs, including the need to <br />temporarily remove the fence? <br />- In the response to question 2.04.10 on page lOc, the mine <br />operator indicated that the target density for shrubs on the <br />reclaimed land would be 1500 to 2000 shrubs per acre. In <br />contrast, page 14C (revised 10/95) states that "There will <br />be no woody plant density standard." Has the landowner <br />approved the elimination of the revegetation standard? <br />- Permit Section 2.05.4(2)(A)(b), page 13, indicates that all <br />manmade structures other than the sedimentation pond will be <br />removed from the site. Despite this statement, it appears <br />that a road and powerlines will be retained as postmining <br />features. It is not apparent that these manmade features <br />will support the postmining land uses, i.e., grazing and <br />wildlife habitat. Has the landowner agreed to retention of <br />the road and powerlines? <br />END OF QUESTIONS <br />2 <br />
