~~;- - <br />Questions on the Reclamation Plan <br />for the Ohio Creek No. 2 Mine <br />in Gunnison County, Colorado <br />- Will the site be reclaimed in accordance with the approved <br />permit reclamation plan? <br />- On 10/4/95, the permittee submitted a request to revise the <br />"regrading and hydrologic control plan." On 10/16/95, DNR <br />approved Technical Revision No. 04, which pertained to <br />backfilling and grading operations. Does Technical Revision <br />No. 04 include the revisions to the regrading and hydrologic <br />control plan? In addition, other than a rescheduling of <br />reclamation tasks, what changes were made to the permit <br />backfilling and grading plan as a result of Technical <br />Revision No.04? <br />- According to finding XXII, page 17, of the OSM June 1987 <br />Mining Plan Decision Document, portals are to have an MSHA <br />approved seal and be backfilled and graded as shown in <br />Exhibit 9. An unsigned, undated sketch of the proposed <br />portal reclamation was found in the permit, but nowhere in <br />the DNR files could there be found a certification attesting <br />to the fact that the portals were reclaimed as planned. <br />State Rule 4.07 requires verification that underground <br />openings have been adequately reclaimed. What information is <br />available, e.g. an engineer's certification, that would <br />attest to the adequacy of the reclaimed portals? <br />- In Section 2.05.4(2)(c), page 14, of the Reclamation Plan, <br />as revised in October 1995, it is stated that reclamation <br />will be conducted in two phases. Is DNR planning a two-phase <br />reclamation operation?; if so, has a schedule been <br />established for the reclamation phases? <br />- In item (8), page 13 of the revised Reclamation Plan it is <br />stated that "Non-coal waste from the underground mine may be <br />brought to the surface and placed in the refuse pile as <br />shown in Exhibit 9. This refuse pile is to be a permanent <br />structure and would consist of roof fall material." However, <br />the postmining topography depiction presented in Exhibit 19 <br />(Post/Mining Topography of O.C. #2 Coal Mine) shows no <br />indication of the refuse disposal structure. Does DNR plan <br />to create the refuse disposal pile that is discussed on page <br />13 and shown in Exhibit 9?; if so, please explain the <br />reasons for retaining such a structure. <br />1 <br />
