Field Order--A written order issued by ENGINEER which orders minor <br />changes in the Work in accordance with Paragraph 9.5., but which does <br />not involve a change in the Contract Price or the Contract Times. <br />Hazardous Substances--Hazardous Substances shall mean all Hazardous <br />Substance, Hazardous Materials and Hazardous Wastes as defined by the <br />U.S. Occupational Health and Safety Administration (OSHA) and the <br />_ Comprehensive Environmental Response, Compensation and Liability Act <br />(CERCLA) and shall include, but not be limited to, Asbestos, PCB's, <br />Petroleum, Hazardous Waste and Radioactive Material. <br />" Hazardous Waste--The term Hazardous Waste shall have the meaning <br />provided in Section 1004 of the Solid Waste Disposal Act (42 USC <br />Section 6903). <br />Laws and Regulations--Any and all applicable laws, rules, <br />regulations, ordinances, codes and orders of any and all governmental <br />bodies, agencies, authorities and courts having jurisdiction. <br />Milestone--A principal event specified in the Contract Documents <br />relating to an intermediate completion date or time prior to <br />Substantial Completion of all the Work. <br />Notice of Award--The written notice by OWNER to the apparent <br />successful Bidder stating that upon compliance by the apparent <br />Successful Bidder with the conditions precedent enumerated therein, <br />within the time specified, OWNER will sign and deliver the Agreement. <br />Notice to Proceed--A written notice given by OWNER to CONTRACTOR <br />fixing the date on which the Contract Times will commence to run and <br />on which CONTRACTOR shall start to perform CONTRACTOR's obligations <br />under the Contract Documents. <br />OWNER--The Board of Water Commissioners of the City and County of <br />Denver and is used to designate the City and County of Denver, a <br />municipal corporation of the State of Colorado, acting by and through <br />its Board of Water Commissioners, sometimes referred to as °Board." <br />OWAff.R's Coasultaat--The person, firm or corporation retained by OWNER <br />to provide engineering services as OWNER's independent professional <br />associate or consultant for the Work. <br />Partial IItilizatioa--Use by OWNER of a substantially Completed part <br />of the Work for the purpose for which it is intended (or a related <br />purpose) prior to Substantial Completion for all the Work. <br />PCSS--Polychlorinated biphenyl's. <br />Petroleum--Petroleum, including crude oil or any fraction thereof <br />which is liquid at standard conditions of temperature and pressure <br />[60 degrees Fahrenheit (15.6 degrees Celsius) and 14.7 pounds per <br />square inch absolute (100 kilo Pascals)), such as oil, Petroleum, <br />fuel oil, oil sludge, oil refuse, gasoline, kerosene and oil mixed <br />with other non-Hazardous Wastes and crude oils. <br />Revised 6-03 <br />GC-3 <br />
