Field Order--A written order issued by ENGINEER which orders minor changes in the Work in accordance with Paragraph 9.5., but which does not involve a change in the Contract Price or the Contract Times. Hazardous Substances--Hazardous Substances shall mean all Hazardous Substance, Hazardous Materials and Hazardous Wastes as defined by the U.S. Occupational Health and Safety Administration (OSHA) and the _ Comprehensive Environmental Response, Compensation and Liability Act (CERCLA) and shall include, but not be limited to, Asbestos, PCB's, Petroleum, Hazardous Waste and Radioactive Material. " Hazardous Waste--The term Hazardous Waste shall have the meaning provided in Section 1004 of the Solid Waste Disposal Act (42 USC Section 6903). Laws and Regulations--Any and all applicable laws, rules, regulations, ordinances, codes and orders of any and all governmental bodies, agencies, authorities and courts having jurisdiction. Milestone--A principal event specified in the Contract Documents relating to an intermediate completion date or time prior to Substantial Completion of all the Work. Notice of Award--The written notice by OWNER to the apparent successful Bidder stating that upon compliance by the apparent Successful Bidder with the conditions precedent enumerated therein, within the time specified, OWNER will sign and deliver the Agreement. Notice to Proceed--A written notice given by OWNER to CONTRACTOR fixing the date on which the Contract Times will commence to run and on which CONTRACTOR shall start to perform CONTRACTOR's obligations under the Contract Documents. OWNER--The Board of Water Commissioners of the City and County of Denver and is used to designate the City and County of Denver, a municipal corporation of the State of Colorado, acting by and through its Board of Water Commissioners, sometimes referred to as °Board." OWAff.R's Coasultaat--The person, firm or corporation retained by OWNER to provide engineering services as OWNER's independent professional associate or consultant for the Work. Partial IItilizatioa--Use by OWNER of a substantially Completed part of the Work for the purpose for which it is intended (or a related purpose) prior to Substantial Completion for all the Work. PCSS--Polychlorinated biphenyl's. Petroleum--Petroleum, including crude oil or any fraction thereof which is liquid at standard conditions of temperature and pressure [60 degrees Fahrenheit (15.6 degrees Celsius) and 14.7 pounds per square inch absolute (100 kilo Pascals)), such as oil, Petroleum, fuel oil, oil sludge, oil refuse, gasoline, kerosene and oil mixed with other non-Hazardous Wastes and crude oils.
