Box 247 <br />Silverton, Co. 81433 <br />Secs. 9 & 10, T41N, R7W and Secs. 14, 15, 30 & 31, T42N, R7W, San Juan <br />County, 140 acres. 112 gold, silver, lead, copper, succession of <br />operator to Sunnyside Gold Corporation. This would have been a "no <br />problem" action except for the notice of violation issued at the October <br />Board Meeting. The Technical Revision stipulations will have been met <br />by the new operator by the set deadline date of December 22; engineering <br />certifications and sampling locations map. Replacement warranties have <br />been received in the amount of $447,543, staff recommended approval of <br />the succession of operators. <br />It was MOVED that the Board approve the succession of operator on File <br />No. 77-378 from Standard Metals to Sunnyside Gold Corporation, noting <br />that the new financial warranty in the amount of $447,543 and <br />performance warranty have been received and that the provisions of the <br />technical revision also transfer to the new operator. SECONDED and <br />PASSED UNANIMOUSLY (O'Connor, Holder, Hullinghorst, Getches, Bloch, <br />Winter and Campbell). <br />Staff Presentation by David Berry: <br />GARRISON GROUP File No. M-85-004 <br />P. 0. Box 886 <br />Wheatridge, Co. 80033 <br />Sec. 15, T3S, R69W, Jefferson County, 16.5 acres, 112 sand and gravel <br />operation. Board t:o consider reason to believe a violation exists. <br />Staff submitted ATTACHMENT G, Probable Violation Presentation with map, <br />and ATTACHMENT H, letter dated September 18, 1985, to the Division from <br />Mr. arreF~n D~rui<.:e, Garrison Group. Possible violations were outlined <br />by staff and slides were shown from site inspection which was made on <br />November 8. <br />Comments were heard from Mr. Mike Hart, representing Flatiron Sand and <br />Gravel, on behalf of the Garrison Group and from Mr. Bob Nelson, an <br />adjacent landowner and representative of the Wolff Ditch Association. <br />It was MOVED that the Board find reason to believe that a violation has <br />occurred on each of the five areas outlined by the staff. SECONDED and <br />PASSED by a Vote of 5 for (O'Connor, Holder, Hullinghorst, Getches and <br />Campbell)/1 abstention (Winter). Refer to Agenda Item 18. <br />
