The application was deemed complete on January <br /> 18,2001,and notices were provided to various local, state,and federal agencies on that date. <br /> Public notice of the renewal application was initially published in the Grand Junction Daily Sentinel once a <br /> week for four consecutive weeks beginning February 1, 2001. The public notice was additionally run in the <br /> Glenwood Post once a week for four consecutive weeks beginning on October 30, 2001, and again in the <br /> Grand Junction Daily Sentinel once a week for four consecutive weeks beginning on October 31, 2001. <br /> Proof of publication was provided to the Division on March 7,2001, December 10, 2001,and July 8,2002. <br /> The Division received only one written comment and one phone comment during the review period. <br /> The Division's adequacy review was conducted with the following sequence of notification letters, <br /> adequacy review letters,response submittals, and associated correspondence. There was a substantial delay <br /> in the review period, which was due to the bankruptcy of LEI, and subsequent delays associated with <br /> transfer of federal coal leases from LEI to CAM. <br /> January 18, 2001—Notices of availability for review and request for comments provided to Bureau of <br /> Land Management Grand Junction Resource Area(BLM),Associated Governments of Northwest Colorado, <br /> Garfield County Commissioners,Colorado Dept. of Health Air Pollution Control Division,Garfield County <br /> Planning Department, Colorado Geological Survey, Colorado Natural Heritage Program, Colorado Division <br /> of Water Resources, Colorado Division of Wildlife (DOW), U.S. Army Corps of Engineers, Colorado <br /> Natural Areas Program, State Board of Land Commissioners, Office of Surface Mining Western Regional <br /> Coordinating Center (OSM), Natural Resources Conservation Service Glenwood Springs Field Office <br /> (NRCS), Colorado Dept. of Health Water Quality Control Division, Colorado River Water Conservation <br /> District, Colorado Historical Society/Historic Preservation Officer (SHPO), and U.S. Fish and Wildlife <br /> Service. <br /> February 5, 2001—DMG received a comment letter from SHPO indicating that approval of the renewal <br /> application would not affect cultural resources. DMG also received a phone comment from Susan Nall, of <br /> the Army Corps of Engineers. Ms. Nall voiced no objection to the renewal, but she did request that the <br /> operator be advised that any proposals to place fill in intermittent drainages would require a permit from the <br /> Army Corps of Engineers. <br /> March 14, 2001—The Division's initial, Preliminary Adequacy Review letter (PAR) was sent to LEI. <br /> Comments received from SHPO and the Army Corps of Engineers were forwarded to LEI with the PAR. <br /> Clarifications, updates and corrections were requested in regard to the following items: Erroneous <br /> information presented on the application form; unacceptable wording of the cancellation clause of the <br /> insurance certificate; ownership and control information inconsistencies or deficiencies, and outdated <br /> compliance information (based on Applicant Violator System checks); outdated right-of-entry information; <br /> outdated operation plan information; narrative inconsistencies regarding generation and disposal of coal and <br /> non-coal waste materials; narrative inconsistencies regarding haul road reclamation; outdated narrative and <br /> appendix information relating to the hydrologic monitoring plan and probable hydrologic consequences <br /> projections; absence of narrative commitment to provide six month notice to property owners prior to <br /> initiation of undermining. <br /> May 18, 2001—The Division's reclamation cost estimate indicating the need for a reclamation bond <br /> increase of $79,026.00, based on a total estimated reclamation liability of $271,563.00, was sent to the <br /> operator. The cost estimate was subsequently revised to$265,431.00, in association with TR-12. <br /> June 14,2001—The Division sent a letter to the operator expressing concern with how the March 30,2001 <br /> bankruptcy filing would affect LEI's ability to post required additional bond and maintain compliance, and <br /> requesting prompt submittal of responses to the PAR letter. <br /> 5 <br />
