8. Please inform the Division how the topsoiUoverburden piles will be protected from the mining <br />operation. If the pit is to be mined adjacent to the piles, the topsoil piles may become unstable and <br />slope failure may occur if an adequate buffer distance is not established. The applicant has the <br />following options: <br />• Demonstrate that the topsoil pile will be stable under the proposed mining conditions using a <br />stability slope analysis, <br />• Maintain a set back distance at 2 times the depth of the pit and revise the maps to reflect this <br />buffer, <br />• Revise the mining and reclamation plan to include benching or terracing and including a slope <br />stability analysis, or <br />• Relocate the topsoil pile to a more stable location, and revise the maps accordingly. <br />Rule 6.4.5 Exhibit E- Reclamation Plan <br />9. Please provide a method of weed control that shall be employed for all prohibited noxious weed <br />species, and whenever invasion of a reclaimed area by other weed species seriously threatens the <br />development of the desired vegetation. <br />10. Please state the topsoil replacement depth for the amended area of the permit. <br />Rule 6.4.7 Exhibit G- Water Information <br />11. According to the text in Exhibit G, Lake County proposes to ultimately mine through and replace the <br />existing Templeton Ditch. Please show where the ditch will be relocated and submit designs for the <br />replaced ditch as a component of the reclamation plan. Specifically, please provide estimated flow <br />rates that the realigned ditch will receive, dimensions of the realigned drainage, appropriate cross <br />sections and how the ditch will be lined to prevent scouring. <br />Rule 6.4.19 Exhibit S-Permanent Man-Made Structures <br />12. Please inform the Division if any roads will be mined through or relocated as a result of the AM-O1. <br />Please state the owner(s) of the road(s) and provide a notarized consent form as required by Rule <br />6.4.19. <br />13. Lake County states that the Templeton Ditch will be protected during mining by leaving a buffer zone <br />of 15-20 feet with a slope from the ditch down to the pit floor of no more than 4h:1 v slope. However, <br />in Exhibit G it states that the ditch will ultimately be relocated (see comment noted above). The <br />Agreements submitted for the protection of the Templeton Ditch also indicate that the ditch will be <br />moved. Please clarify this discrepancy. <br />14. The notary on the Ditch Agreement signed by Pat Chant is incomplete. Please have the agreement <br />completed by the notary. <br />Please be advised that Half Moon Pit AM-01 Application may be deemed inadequate, and the application <br />may be recommended for denial on October 15, 2007 unless the above mentioned adequacy review items <br />are addressed to the satisfaction of the Division. If you feel more time is needed to complete your reply, <br />the Division can grant an extension to the decision date. This will be done upon receipt of a written <br />waiver of your right to a decision by October 17, 2007 and request for additional time. This must be <br />received no later than the deadline date. <br />
