Cattany <br />Division Director <br />Natural Resource Trustee <br />Listed below are adequacy review comments on the Half Moon Pit Amendment Application 01 (AM-01), <br />Permit Number M-1977-071. The Division of Reclamation, Mining and Safety (Division) is required to <br />make an approval or denial decision no later than October 15, 2007, therefore, yolu response to the <br />following adequacy review concerns should be submitted to the Division as soon as possible. <br />1. As required by Rule 1.6.2 (1)(g), please submit the proof of publication of the public notice circulated <br />in the local newspaper, all owners of record of surface and mineral lands, easement holders, and <br />owners of record of surface lands that are within 200 feet of the boundary of the affected land. Proof <br />of notice may be return receipts of a Certified Mailing or by proof of personal service. <br />2. Rule 6.2.1(2) requires that maps be signed by a registered land surveyor, professional engineer, or <br />other qualified person. The maps submitted to the Division were not signed. Please resubmit a <br />signed copy of the maps. <br />3. The Division received comments from the Office of the State Engineer and the Colorado Historical <br />Society regarding the application. The letters are attached. Please address the comments noted in <br />the letters, and make any changes the application as necessary. <br />Rule 6.4.3 Exhibit C- Pre-Mining and Mining Plan Maps <br />4. Per Rule 6.4.3(g), please state all of the owners of Templeton Ditch. Please also state if any utilities <br />are within 200 feet of the proposed permit area. <br />Rule 6.4.4 Exhibit D- Mining Plan <br />5. Please state the total area of land to be affected (in total) compared with the permitted area of 80 <br />acres. <br />6. Please state the depth of the pit in the amended area and estimate the volume of overburden and <br />topsoil that will be stored on site to facilitate reclamation of the pits. <br />7. The mine plan states that topsoil piles will be stored at a maximum slope of 3h:1 v. Please inform <br />the Division how the piles will be protected to prevent wind and water erosion.
