EXHIBIT B <br />STIPULATIONS <br />CASTLE CONCRETE CO. PERNIIT # CO-200-MS-00-O1 <br />MITIGATION MEASURES: <br />1. To maintain visual integrity, a setback will be maintained along the rim of the <br />mesa. This setback will be at least 50 feet and may be up to 100 feet, depending <br />upon the strength and secureness of the rock on the mesa edge. This setback will <br />ensure that the mining area will not be visible from the north or south slopes to <br />the mountain. <br />2. Monitoring for noxious weeds will be carried out, and a plan for dealing with <br />the potential problem if it arises must be prepared. The bond accessed by the <br />Colorado Div. Of Minerals and Geology should include funding for dealing with <br />this potential problem. <br />3. Storage of fuels and other regulated materials should not be permitted on site. <br />All spills and other events where hazardous or regulated materials are released <br />inadvertently on site should be reported to BLM immediately and cleaned up or <br />removed in accordance with existing law. <br />REMARKS: <br />If necessary the mining plan will include water control structures which <br />adequately deal with reducing sedimentation and erosion both during and after <br />final mining operations. The reclamation plan should also include language that <br />specifies the substantial effort that will be necessary to establish a native <br />vegetation regime in the mined area, either by soil supplementation or treatments <br />of existing soils. <br />Coordination with the Colorado Div. Of Wildlife may be necessary to discuss <br />possible requirements for fencing all or part of this area. <br />
