-~ <br />• III IIIIIIIIIIIII III D RR~ <br />Ml~Ut2S, R~gUSt Z~-~1, 1992 999 auo~ectTo Board Approval a <br />Mr. Chefas showed the Board a large photograph of the area and <br />discussed the site which includes a lake. He said material extracted <br />from the site in 1986 was given to a church in the area. Mr. Chefas <br />discussed the purchase of some water rights and an augmentation plan <br />for a subdivision. He explained that when he learned that the operator <br />would be providing construction for another project in the area, he <br />contacted them and offered material from his site in exchange for <br />constructing the lake which would be 4 to 7 feet deep. He referenced a <br />letter to the Division from the County of Alamosa, EXHIBIT B, which <br />stated that the County has no special requirements for construction of <br />lakes, as long as all other requirements are met. He showed panoramic <br />photographs of the site and answered questions from the Board. <br />Mr. Todd A. Stotkebrand, with Asphalt Constructors, Inc., the <br />contractor-operator, discussed this matter briefly. He said several <br />contractors have removed and retained material from this site. Mr. <br />Stotkebrand said the material is processed and sold. <br />In response to a question from the Board, Mr. Chefas said the site is <br />not currently covered by a local building or excavation permit. <br />The Board explained that, without an active reclamation permit from the <br />city or local county government that guaranteed an end use or <br />reclamation, a MLR reclamation permit would be required to continue <br />this activity. <br />The operator excavated material from this site which was removed <br />offsite, sold and put to a beneficial use elsewhere. The Board <br />explained that this is considered mining and that the this type of <br />activity does provide competition with any permitted operators. <br />It was MOVED that the Board deny the petitioners' request for a <br />Declaratory Order.
