Hokestra Amendment Application 03 (AM- 03)- Adequacy Review
Dear Mr. Nelson,
Listed below aze adequacy review comments for the Hokestra Amendment Application 03 (AM-03),
File No. M-1980-149. The amendment changes the postmining land use to developed water resources
with the installation of a compacted clay liner and a slurry wall azound the mining phases. The Division
of Reclamation, Mining and Safety ("Division") is required to make an approval or denial decision no
later than January 3, 2007, therefore, your response to the following adequacy review concerns should
be submitted to the Division as soon as possible.
1. As required by Rule 1.6.5 (2), please submit the proof of publication of the public notice circulated
in the local newspaper and all owners of record of surface lands, and easement holders that are on
the affected land and within 200 feet of the boundary of the affected land. Proof of notice may be
return receipts of a Certified Mailing or by proof of personal service.
2. The Division received comments from the Colorado Historical Society and the Army Corps of
Engineers. Attached aze the letters for your review.
3. Rule 6.2.1(2) requires that maps be signed by a registered land surveyor, professional engineer, or
other qualified person. The maps submitted to the Division were not signed. Please resubmit a
signed copy of the maps.

4. Rule 3.1.9(3) requires that topsoil stockpiles be stored in places and configurations to minimize
erosion and be located in areas where disturbance by ongoing operations will be minimized. In
accordance with Rule 3.1.9(1), topsoil and overburden must be segregated and stored separately.
Please revise the exhibits to depict the location of the topsoil piles. In addition, please state the
configurations of the piles and how they will be protected from wind and water erosion.
