The amendment changes the postmining land use to developed water resources <br />with the installation of a compacted clay liner and a slurry wall azound the mining phases. The Division <br />of Reclamation, Mining and Safety ("Division") is required to make an approval or denial decision no <br />later than January 3, 2007, therefore, your response to the following adequacy review concerns should <br />be submitted to the Division as soon as possible. <br />1. As required by Rule 1.6.5 (2), please submit the proof of publication of the public notice circulated <br />in the local newspaper and all owners of record of surface lands, and easement holders that are on <br />the affected land and within 200 feet of the boundary of the affected land. Proof of notice may be <br />return receipts of a Certified Mailing or by proof of personal service. <br />2. The Division received comments from the Colorado Historical Society and the Army Corps of <br />Engineers. Attached aze the letters for your review. <br />3. Rule 6.2.1(2) requires that maps be signed by a registered land surveyor, professional engineer, or <br />other qualified person. The maps submitted to the Division were not signed. Please resubmit a <br />signed copy of the maps. <br />Rule 6.4.4 Exhibit D- Mine Plan <br />4. Rule 3.1.9(3) requires that topsoil stockpiles be stored in places and configurations to minimize <br />erosion and be located in areas where disturbance by ongoing operations will be minimized. In <br />accordance with Rule 3.1.9(1), topsoil and overburden must be segregated and stored separately. <br />Please revise the exhibits to depict the location of the topsoil piles.
