Golden Eat le Mine; oe. 3 <br />I then thoroughly described the Colorado DMG regulation which was in violation and specified <br />in the IBLA decision, Rule 4.20.3 (2) (a) (b) & (c). We discussed both the 1991 and current <br />requirements of the rule, and also discussed the 30 CFR Colorado State-Federal Cooperative <br />Agreement found at 30 CFR 906.30, Article VIII, 19, which requires OSM to cite the Colorado <br />approved regulatory program rules on OSM Federal Notices of Violation (NOV). I indicated the <br />inspection was concluded, asked if there were any questions, and indicated I waz leaving to <br />prepare and serve a NOV citing the above provisions to Basin Resources, Inc. Ms. Tatum <br />requested I return and give her a copy of the NOV if possible, and also requested a faxed copy of <br />the original OSM Ten Day Notice 93-020-370-005 issued in response to the above noted citizen <br />complaint. I agreed to do both. <br />I then met with Ron Thompson, a consultant who represents Bazin Resources, Inc. and the <br />Golden Eagle Mine. I identified myself to Mr. Thompson and explained the nature of my follow- <br />up inspection at the Tatum residence. Mr. Thompson was familiar with the IBLA decision. We <br />discussed the IBLA decision, and I gave Mr. Thompson a thorough accounting of my inspection <br />procedures and observations at the Tamm residence. I thoroughly described the NOV process and <br />we discussed the applicable State and Federal citations noted above. I prepared <br />NOV 00-140-116-001 in Mr. Thompson's office and served it on him explaining the OSM and <br />Office of Hearings and Appeals NOV appeal process and deadlines, the OSM penalty assessment <br />information submittal process, and the NOV abatement deadline. I gave Mr. Thompson copies of <br />the DMG 1991 Rule cited above and the July 26, 2000, IBLA decision. This concluded service of <br />the NOV and concluded the inspection. <br />I returned to the Tatum residence and provided a copy of the NOV to Ms. Tatum. Ms. Tatum and <br />Mr. Gerity thanked me for my time, and Mr. Gerity requested a copy of any written agreements <br />or memorandums of understanding between OSM and DMG with respect to State and Federal <br />enforcement of the 1992 Energy Act Amendments.
