No excavation will occur within 30 feet of an adjacent property, property <br />easement, irrigation ditch or significant man-made structure without written approval of <br />the owner of such property, easement, ditch or structure. No excavation will occur nearer <br />than l25 feet from any residence not owned by the Applicant. <br />Air emissions resulting from mining and aher operations will comply with <br />standards established by the Mesa County Health Department and the Colorado <br />Department of Health, Air Quality Control Division. Applicant has been granted an Air <br />Pollution Emissions Notice (APEN) and construction permit for present site operations. <br />An authority of the Grand Junction Office of the State of Colorado Department of Health, <br />Air Quality Control Division, has advised Applicant that a new APEN will not be <br />required for continued mining operations as proposed. <br />Al] water uses will conform to standards established by the Colorado State Water <br />Pollution Control Commission, and the water laws of the State of Colorado. <br />3 <br />
