Although I believe <br />the enclosed letter explains Walden Coal Company's po;iticn on this <br />matter,~I thought that some clarification and further explanation <br />might be beneficial. <br />Walden Coal has been pumping water out of the pi= since <br />February 21, 1983. Water which was pumped from the pit was used for <br />dust control on the Bourg property, or placed directly into sedimentation <br />ponds in accordance with the approved mine plan. On r4arch 4 sedimen- <br />tation pond B developed severe leaks which caused all the water collected <br />in the pond to drain into the active pit. A considerable amount of <br />water had accumulated in the pit by May 23, due to tl~e continuous <br />precipitation at the mine site. Also, as a result of the excessive <br />precipitation, C pond was close to capacity and B pond was too wet <br />to make repairs. <br />On May 23, 1983, Walden Coal Company began to discharge water into <br />Mann Draw. Mike Savage was contacted about the discharge at that time. <br />Several measures were taken to mitigate the impacts of discharging pit <br />water into the draw. Rip-rap was placed at the discharge point to <br />minimize erosion and the water was passed through hay bales in order <br />to reduce the amount of suspended solids before leaving the property. <br />
