- `. <br />ENFORCEMENT ACTIONS <br />The state issued three Notices of Violation as a result of <br />this inspection. <br />C-95-006 was issued for failure to implement appropriate <br />sediment control measures to minimize erosion to protect <br />topsoil, vegetation, and the hydrologic balance. This <br />pertains to a gully caused by surface runoff from reclaimed <br />areas above Pit B Ramp Road. The gully extends approximately <br />50 Yards from the ramp road across regraded spoil and into <br />undisturbed soil and vegetation to the drainage channel above <br />pond 006. <br />C-95-007 was written for erosion and siltation problems <br />associated with haulroads at the following sites: <br />1. Tie Across Haulroad (TAHRD) at TAHRD-7. Sediment <br />deposits extended off permit into wheat field. TAHRC #1; <br />erosion of outlet channel. <br />2. Mine Entrance Haulroad at culvert ME-5. Sediment <br />accumulating in gulch. A silt fence had been installed across <br />'the gulch (stream). Silt had previously been removed from <br />stream and placed on stream bank. <br />3. "A" Haulroad at haulroad ditch A-1 near culvert A-1. <br />There was considerable ditch erosion in this area. <br />4. "G" Haulroad - sediment delta into Dry Creek. <br />Sediment from this road has been by-passing the silt fence and <br />resulting in a sediment delta in Dry Creek. <br />The state is requiring the company to submit a Technical <br />Revision (TR) addressing each of these erosion and sediment <br />control problems. <br />C-95-008 was issued for failure to insure that perimeter <br />markers and buffer zone markers were in place as required. <br />the specific sites were along the Tie Across Haulroad near the <br />TAHRD 7 ditch and the buffer zone along Dry Creek by Haulroad <br />uGn_ <br />Ten-Day Notice (TDN) X95-020179-002 was issued consisting of <br />three violations. Violation #1 was for failure to design and <br />certify the impoundment which was constructed at the outlet of <br />Haulroad Ditch A5. This structure is approximately 50ft. x <br />6oft. and three feet deep with no rip-rap spillway. Although <br />this structure only collects runoff from disturbance created <br />by road construction and the road surface it is an impoundment <br />which is required to be designed and certified. Violation #2 <br />addresses the area below the discharge of Culvert A3 where a <br />series of sumps and silt fences were installed to prevent <br />additional sediment to the stream flow or to be deposited on <br />private property. At least one of these structures was <br />constructed outside the boundaries of the permit. Violation <br />#3 deals with haulroad certifications.
