S, Colorado
Case No. 02CW211; Ruling of the Refertx amt Dxree of the Court
Lerar`e West, r„c.
which, inter alts, decreed a plan for augmentation to provide a legal water supply for the existing
gravel pit and other structures. The plan decreed herein shall supersede the plan for
augmentation In Case No. 97CW099 with a new plan that provides a water supply system for an
increase in production tate~ for the gravel pit.
The purpose of the augmentation plan described herein is to expand the
augmentadoa protecdoa for the water supply for the Gypsum Ranch Sand and Gravel Pit. The
structures to be augmented have junior waver rights which are subject to a tail by downstream
senior water rights. Therefore, dte depletions from the industrial and domestie uses associated
with the gravel pit operation must be augmented. The plan will allow for the augmentation of
out-of-priority depletions from use of water divemd by the Gypsum Ranch Eagle River Pump;
the Gypsum Ranch Weil; dle Schmidt Gypsum Ranch Sprit-ga No. 5, 6, 7 and g; and the Gypsum
Ranch Sand and Gravcl Pit.
B. F,etimated Water Requirements. Consumptive Uses and Depletions. The proposed
water demand for the gravel pit wilt include the production of 300,000 tons per ycar ('I'PY) of
crushed and screened road base products, 200,000 TPY of washed sand and gravel produete,
60,000 cubic yards (CY) of rod-mix coactete sad domestic wader for sanitation facilities. Exhibits
B and C, attached hereto and incorporated herein, s,rnn, artvr the estimated diversions (Exhibit
B) and depletions (Exlullit C) for the gravel pit and domestic uses from the structures to be
augmented. The gravel pit at+ea is a gravel bench above the Eagle River and is aotsub-irrigated.
Annual diversions are estimated at 37.83 and related annual consumptive use is estimated at
37.35 A.F.
Water will be required for dust suppression in the crushing operation, for washing
in the sand and gravel operation and for mixing with cEment, sand and gravel to produce
concte4e. Water will also be required for dust suppression for the roads and for wanting concrete
tacks and other facilities end equipment, and for sanitation facilities for up to 24 office and yard
employees.
A portion of tite project's annual wasumptive use may occur at times whoa there
is no call on the Eagle River system. Nevertheless, the plan provides for full replacement of
depletions from Applicant's uses from the structures to be augmented.
Annual depletiotffi associated with the gravel pit operation equa137,55 acre-feet,
which amount includes 26.05 acre-feet for irrigation season depletions. Most of the irrigation
season depletions will be augmented using historical consulrtpdve use from dry-up of lands under
dte Applicant's ownership in the C M Stremme and Gates Ditch.
