C~ <br />• <br />STATE OF COLORADO <br />MINED LAND RECLAMATION BOARD <br />DEPARTMENT OF NATURAL RESOURCES <br />IN THE MATTER OF: Castle Concrete Company ) NOTICE OF VIOLATIOIJ M-90-070 <br />. ox ) MODIFIED BOARD ORDER <br />0 0. prings, ) CONDITIONAL CEASE AND DESIST ORDER <br />AND ORDER TO PAY CIVIL PENALTIES <br />T0: Castle Concrete Company and all other persons engaged in or oiNning or <br />controlling the following operation: Snyder Ouarry, Section 32, Township <br />13 South, Range 67 West, of the 6th Prime Meridian, E1 Paso County, Colorado. <br />FINDINGS OF FACT <br />Pursuant to the authority vested in the State of Colorado Mined Land <br />Reclamation Board by C.R.S. 34-32-124, the Board hereby makes the following <br />findings of fact: <br />1. Castle Concrete Company is permitted to conduct a mining operation under <br />the terms of Permit M-77-210 located in Section 32, Township 13 So~~th, <br />Range 61 West of the 6th P.M., in E1 Paso County, Colorado. <br />2. The Mined Land Reclamation Board conducted a Formal Public Hearing on <br />July 25-26, 1990 to consider possible violation of the terms of Permit <br />M-77-210 and C.R.S. 34-32-101 et seq. <br />3, The Mined Land Reclamation Division presented evidence at the Formal <br />Public Hearing on July 25-26, 1990, demonstrating that: <br />a. Castle Concrete Company had been ordered by the Mined Land <br />Reclamation Board on January i6, 1990 to reclaim the damage to the <br />slope just west of the Phase I area and the damage due to material <br />slides along the access road shoulder. Reclamation was to include <br />regrading of the access road slide area 1, 2, 3, and 4. Reseeding <br />of all disturbed areas, and replanting lost or damaged trees in <br />these areas. Reseeding was to have been accomplished by November 1, <br />1990. Trees were to have been planted by June 1, 1990, and were to <br />have been established to the pre-existing density. <br />b. Castle Concrete Company, by June 1, 1990, had not completed the <br />regrading or reseeding of the Area 2, Area 3, and Area 4 slides, nor <br />had replanted any trees in any of the disturbance areas. <br />
