5. The cross-section'on the revised.Exhibit C, Pre-mining/Mining Plan map has been corrected <br />to indicate that the setback varies. As previously discussed, the operator commits to maintain <br />a minimum 50-foot setback from the south end of the permit boundary as illustrated on the <br />Exhibit C. Other setbacks remain at a minimum of 25 feet. <br />6. The location of potential overburden/topsoil stock piles have been located on the revised <br />Exhibit C, Pre-mining/Mining Plan map. <br />7. An acreage reduction request has been submitted to the Division <br />8. The current and proposed mining operation and processing facilities operate under a Spill <br />Prevention, Control, and Countermeasures Plan as required by the regulation found in <br />40 CFR Part 112. According to the regulation, facilities subject to the rule must prepare and <br />implement a plan to prevent any discharge of oil into or upon navigable waters of the United <br />States or adjoining shorelines. 'T`his. plan includes procedures for the safe transfer, <br />containment, and emergency response of petroleum products stored on-site. <br />In addition, the currant mining activities operate in compliance with a Colorado Dischazge <br />Permitting System (CDPS) discharge permit. The permit includes-the continued updating <br />and implementation of the site Stormwater Management Plan. The plari is designed to <br />prevent the contact and transport of potential contaminants by stormwater flows. <br />There are no hazardous wastes generated by the current or.proposed facilities. <br />9. Prior to relocation of the conveyance ditch, CCWCD will be consulted and the new location <br />and design will be specified. This information will be provided to the Division at that time in <br />.the form of a technical revision. <br />10. Unimproved roads and fences on the affected land and owned by the applicant may be <br />removed during mining activities. <br />11: Flows-from dewatering trenches will.be circulated through sedimentation ponds prior to <br />discharge if it is necessary to meet discharge quality requirements stipulated in the current <br />site Colorado Discharge Permitting System permit. The discharge permit for this site <br />includes monitoring parameters for dewatering the sand and gravel mine area and monitoring <br />is conducted in accordance with those parameters. <br />12. Some, fines and/or residue material generated from crushing concrete or asphalt through the <br />recycling plant may remain on-site, but it is not anticipated that this material would be used <br />for backfill material. If applicable, the applicant agrees to provide to the Division with the <br />appropriate-notices and affidavit certifying that the material used for backfill is clean and <br />inert in accordance with Rile 3.1.5(9) of the Constructiori Rules and Regulations. <br />It is' anticipated that fill material from property west of the Platte Valley site will be imported <br />. and used for backfill. An affidavit certifying that the material from this area is clean and <br />
