SHELTON, DJrsctor <br />DATE: June 19, 1986 <br />T0: Kerr Coal Company File <br />FROM: Steve Renner <br />RE: ABATEMENT FOR NOV C-86-022 <br />On June 6, 1986 the Division received a request from Kerr Coal Company to <br />extend the Abatement for NOV C-86-022, specifically the abatement procedure <br />for Well AO-2. The requested extension date was July 31, 1986 to complete the <br />well, and August 31, 1986 to submit the required data. The Division, on June <br />11, 1986 sent Kerr Coal a letter and modification form for NOV and CO, which <br />extended the abatement procedure for Well AO-2 until June 30, 1986. The <br />operator was informed in the June 11 letter that the Division would either <br />approve, deny, or modify the Kerr request after an on-site inspection. <br />The on-site inspection was conducted on June 11, 1986. It was determined at <br />that time that the Well AO-2 area was dry enough to allow drilling operations <br />to begin. The inspection report, which was given to mine personnel, indicated <br />that a light drill rig could access the site. The inspection report indicated <br />that the extension until June 30, 1986 was warranted. <br />On June 18, 1986, Mr. David Gossett of Kerr Coal Company telephoned the <br />Division to say he had a problem with the two week extension. Mr. Gossett <br />indicated that a contract driller may not be avai]able prior to July 1, 1986. <br />I informed Mr. Gossett that I would look into the matter. At 4:00 p.m, on <br />June 18, 1986, Kerr Coal was contacted and informed that the abatement would <br />not be extended beyond June 30, 1986. Mr. Gossett was not in the office at <br />the time of this call; therefore, the message was left with his secretary. <br />The secretary was asked to have Mr. Gossett return my call if he would care to <br />discuss the matter further. No call from Mr. Gossett has been received, <br />It is the Division's opinion that Kerr <br />driller since the time NOV C-86-022 was <br />citation of Rule 5.03.2(2)(c)(iv) is no <br />SR/ddt <br />cc: Michael S.
