Lemm <br />Governor <br />June 20, 1986 <br />Mr. David Gossett <br />Kerr Coal Company <br />One Taber Center <br />1200 Seventeenth Street <br />Denver, Colorado 80202 <br />Re: Extension of Abatement Date for NOV C-86-022, File No. C-80-006 <br />Dear Mr. Gossett: <br />On June 6, 1986 Kerr Coal Company requested an extension to the abatement of NOV <br />C-86-022 as it pertains to Well AO-2. Kerr Coal Company cited extenuating climatic <br />conditions as the basis of this request. On June 10, 1986, the Division extended <br />the abatement procedure for Well AO-2 until June 30, 1986, an extension of time <br />beyond the normal 90 day maximum time allotted for abatement. <br />An on-site evaluation was preformed during a monthly mine inspection on June 11, <br />1986. Well Site AO-2 was accessed via a two wheel track which led to Bush Draw <br />from the "Dodge Road". Even though fairly heavy rains occurred on or about <br />June 9 and 10, 1986, the access and well site were found to be relatively dry. <br />Based upon past drilling experience in North Park, and the field inspection of June <br />11, 1986, it is felt that drilling the replacement well for AO-2 may be <br />accomplished with little environmental harm. <br />Data submitted to the Division by Kerr Coal indicated that Kerr has been aware of <br />the need to replace Well AO-2 since mid-July, 1984. The Division believes that <br />Kerr has had ample time to replace Well AO-2 and reinitiate monitoring as per the <br />approved permit. Therefore, in accordance with Rule 5.03.2(2)(e) of the <br />Regulations, based upon the on-site inspection and based upon the Kerr Coal Company <br />submittal of June 6, 1986, the Division finds that an extension of the abatement <br />date for Well AO-2 (NOV C-86-022) beyond June 30, 1986, is not warranted. <br />If you have any questions or <br />Sincer 1~ <br />Steven Renne <br />Hydrologist <br />SR/ddt <br />cc: Michael S.
