being farmed (crops in aerial photograph). The opening of extraction activities
has been deferred, possibly for another two years, and the DMG will be notified
upon commencement of this Phase of the Pit 1 Permit.
Locations of structures and yards are identified and measured and will be
`extracted from the permit area, leaving 76.3945E acres for extraction activities.
Soil salvage will occur over the entire affected area, and volume will be saved
adequate to resod affected lands remaining above water to a minimum depth of
six (6) inches. Warranty determinations provide for 16.5233± acres of
anticipated shoreline, with approximately half of the intended b0 acre pond
area, to be resoiled and revege#ated before the warranty for this portion of the
site would begin to float across the balance of the Amendment 2 area on an acre
of area under water to acre of affected land basis beyond that point.
The approximate area of the resulting pond is profiled on Map II, but the
irregularity and full extent intended will be dependent upon the true nature of
the deposit material and course of extraction activities. The situation can and
will be adjusted in subsequent Annual Reports.
NOTE: In our discussion on the matter of the Annual Reports, it was
determined that the fee and reporting dates would not change, as indicated in
the 1 August 1996 Technical Revision submittal, but that aerial photography
gathered in September -October precedent to that report would be the
foundation upon which Annual Report information was based, beginning with
September -October 1997 [199$ reporting year], since the June 1996 aerial
photograph is the original Benchmark. This means that the report due in June
1997 will be based upon the June 1996 aerial since no significant changes are
anticipated through October. This understanding applies to the adjacent
Dakolios Pit [M$4-f)36] as well.
II. Virtually all of the banks of the St. Vrain River have been affected by the
floods of 1995, the effects of which the operator should be pardoned from any
further reclamation activity. These effects include the intrusion of material into
the Amendment 1 lakes, forming islands North of the St. Vrain River.
~- III. The majority of the Amendment l lands have been graded and seeded. The
resulting vegetation was disturbed or destroyedbylandowner activities over the
areas, and release from further responsibility is sought by the operator. The
landowner runs a fishing club over the Amendment 1 lakes, driving and parking
recreational vehicles over the banks, and utilizing the remaining stockpile
Varra Companies, Inc. -Pit 1 -DMG Permit M-74-052 3
Addendum -TECHNICAL REVISION - O8/ 16/ 96.
