4. As discussed with Tom Logue previously, the original notices to the Commissioners and the <br />SCD included an incorrect timeframe for public comment. The public comment period for <br />an amendment to a 1 12c permit is 20 days following the fourth of four consecutive weekly <br />publications of the public notice. The notices submitted to DMG on February 4, 2004 still <br />specify an incorrect timeframe. Additionally, the timeframe, as allowed by statute, expired <br />many months ago. At this point, there are two options. 1) deliver notices to these entities <br />indicating that they have 20 days, from the date they are re-noticed, to comment on the <br />application; or, 2) have both entities sign statements indicating that they have no comments <br />regarding this specific application and that they waive their right to a 20 day comment <br />period. <br />If you need additional information, please contact me at the Division of Minerals and Geology, <br />Grand Junction Field Office, 101 South Third Street, Room 301, Grand Junction, Colorado 81501, <br />telephone no. 970-243-6368. <br />Sincerely, <br />~!~a~` ~~ <br />Steve S.
