Mine Plan Map Cc has been modified to show the maximum extent of waste rock <br />construction at a late phase of mine development That is, the map shows the <br />footprint of the waste rock dump development approaching the southern boundary <br />of the affected land area. This footprint includes the slope along the tce of <br />rockpile that will be graded to a fina13:1 slope and capped with up to 1' of topsoil <br />prior to seeding and mulching operations. The reference to upper lifts of waste <br />rock placement above the existing lower staging azea was made to allow for <br />maximum flexibility for placement of waste rock produced from hangingwall <br />development north of the present mining operation that may need to be moved <br />during or prior to ore extraction_ The upper waste rock lifts may range fiom 20' <br />to 30' high and will allow for focal grade of no more than 3:1 slopes on the <br />southern aspect of each lift, with ample mom for access road, ramp, and ditches to <br />control potential run-off. Atypical cross section of late stage rockpile lifts is <br />included in this mailing_ <br />16. Inquiry with Forest Service personnel and Chaffee County Road and Bridge <br />personnel has confirmed that under ainter-government agreement, Forest Service <br />Road 228 is considered a Forest Service Road operated under the jurisdiction of <br />the US Forest Service. Colorado Marble has applied for and acquired a special <br />use permit for FS Road 228 from the USFS identified as SAL 378, which allows <br />for access to the Lilly Mines Site by Lilly Mines consultants and contractors. <br />Colorado Mazble has applied for a Commercial Haulage permit for FS 228 which <br />is currently under review by USFS personnel. <br />17. Under the commitments of SAL 378 Special Use Perntit, Colorado Mazble, Inc., <br />has committed to construction and modification of the roadway at several <br />locations, which aze shown on Map Cc submitted with this mailing. These road <br />improvements include two culvert replacements, two areas where existing culvert <br />inlets have been cleaned and rip-rapped, and one sediment basin construction at <br />the upper switchback of FS Road 228 app. '/. mile from the mine site gate. All of <br />this construction was performed within the 60' ROW required by Permit SAL 378 <br />and is within the newly drawn affected land bormdaries for the rcelamarioa permit <br />amendment proposal. Please note that these improvements were required by the <br />Forest Service as apre-requisite for permit approval. Additional road <br />improvements may be required under to meet requirements for Commercial Use. <br />These road improvement have yet to be ide~fied by the Forest Service nor <br />agreed upon by Colorado Marble, Inc. However, it is understood from <br />discussions with Foust Service personnel that such road improvement will be <br />made within the boundaries of the ROW established by the Special Use Permit <br />and reflected in the amended acreage of affected land. All road improvements <br />will be pem~anent in nature and will not be subject to removal at the end of the <br />mining operations.
