The refuse pile is small as compared to other mine <br />sites, approximately 6,400 c.y. of coal refuse material. The <br />gullies downslope from the refuse pile were approximately 1-2 ft <br />wide at the onset, with a 6" channel to the road. The length of <br />the gully is approximately 55 feet. The water once reaching the <br />road level would run off into the road ditch and be carried down <br />the road ditch, untreated by any sediment pond. <br />Length of the duration of the violation is estimated to be since <br />last summer, according to a conversation with the consultant; Larry <br />White who mentioned the major precipitation event from last year <br />being responsible for berm deterioration in the refuse area. See <br />the enclosed faxed letter from Larry White, dated July 16, 1993. <br />Fault: Historically, runoff above the refuse area has been <br />discussed with the Division, with the Division permitting the <br />operator to allow all surface runoff that reaches the refuse pile <br />to be carried via the south running ditch that empties into the <br />upper bench pond for treatment before being discharged (see July <br />16, 1993 letter from Larry White). Both the ditch and the berm in <br />this case, allocated to control surface flow, were inoperable at <br />the time of the inspection.
