Exhibit D MINING PLAN <br /> Unless specifically discussed below the methods described in <br /> the 1977 and 1981 mining plans will remain unchanged. Existing <br /> sloping, grading and shaping plans will apply to the new area <br /> since they are similar to the area now in the permit. The <br /> following amendments to the mining plan are numbered sequentially <br /> to follow those submitted in 1981. We currently have well <br /> permits on each lake shown on the 1981 maps. We will revise our <br /> well permit to include the Stage 2 - Part B and Stage 5 lakes <br /> prior to mining commencing in those stages. <br /> AMENDMENT 7 - Acreage added to Permit <br /> This section describes the changes in area made to the <br /> permit. in 1997 we leased additional lands in the southern area <br /> from Unaweep Charolais Ranches, Inc. , for mining. In Stage 2 - <br /> Part A we will square up the southeast corner of that stage by <br /> adding 2 .40 acres ±. This will create an area where the houses <br /> on Highway 141 will become lake front property. These houses are <br /> owned by Unaweep Charolais Ranches and in the lease agreement we <br /> have to stay 100 feet away from the houses with our digline as <br /> shown on the Mining Plan Map. One minor change to the lake <br /> configuration in Stage 2 - Part A is in the west arm where the <br /> existing settling pond is located. This area may be silted in <br /> with wash water to create a shallow divider as shown. This will <br /> not affect the final reclamation plan since it will have a <br /> shallow water cover. <br /> The largest area added on the south side is the 32 .04 acre <br /> area east of Hwy 141 adjacent to the Gunnison River. This area <br /> will be mined using the method described in the original mining <br /> plan. we will maintain a 100 foot setback from the highwater <br /> line of the Gunnison River on the east and East Creek on the <br /> south. A 25 foot setback will be maintained along HWY 141 . The <br /> material will be hauled to our processing plant in Stage W. The <br /> final slope will be 3h to lv from five feet above the water line <br /> to 10 feet below and 2h to lv from there to the bottom of the <br /> excavated area. <br /> in 1997 Whitewater Building Materials Corp. purchased <br /> additional land north of the Gunnison River adjacent to lands <br /> purchased in 1980. In this area we are adding 92 .53 acres ± <br /> north of Coffman Road to the permit. We also traded BLM a parcel <br /> west of Coffman Road for an equal amount on the west side of old <br /> Stage 4 that adds 0.92 acres ± to Stage 3 - Part B. The newly <br /> added areas will be mined using the methods described in the <br /> existing permit with the only change being the sequencing changes <br /> as shown on the Mining Plan Maps and Mining Plan timetable. <br /> The most distinctive change is, to start mining north of <br /> Coffman Road in Stage 3 - Part A so that we can create a settling <br /> pond to collect the fines as the area north of the river is <br /> mined. The slopes into this area will be left nearly vertical <br /> while it is being filled so it will hold more. The distance <br /> around this vertical slope stage is less than what we have <br /> accounted for in our Reclamation Cost Estimate (Exhibit L) . <br /> 5 <br />
