If the clarifi~:ation is <br />3 needed, the staff has an opportunity to see:t; <br />4 clarification. If a definition of a particular <br />5 process is necessary, so that the staff can either, <br />6 say, accept or reject at its recommendation to this <br />? Board, that's what the 120 days is designed for. <br />8 But the statute is not that •-- doesn't <br />9 have those definitions. We submit that the•;~'re <br />10 implicit in the very formation that the legislature <br />11 formulated and gave to the Board and under its own <br />12 rules. So I am saying that the Board has been <br />13 removed from the respo nsibility of decision by the <br />14 legislative enactment under which it exists, wh ich <br />15 says, in our opinion, the permit as recomme:zded by <br />16 staff at the close of the June hearing, within the <br />17 120-day limi t, gust be issued upon the posting of <br />18 financial wa rrants. <br />19 CT_:AIRMAN DANIELSON: Thank you very <br />20 much. <br />21 MR.
