The application to amend M-2001-085 seeks to <br />accomplish three items. <br />1. The amendment, if approved, will incorporate the 2.2 acres covered by 110 Limited <br />Impact Permit M-2002-013 into M-2001-085. These 2.2 acres are used for an access <br />driveway to the 124`" Estates Sand and Gravel Mine. <br />2. The amendment, if approved, will add approximately 0.4 acres to M-2001-085 for a new <br />crossing of the Fulton Ditch, as shown by Exhibit C-2. This new crossing of the Fulton <br />Ditch was required by the Adams County Commissioners, so that truck traffic to the <br />mining area on the west side of the Fulton Ditch will continue to access 120' Avenue at <br />the same location, thereby maintaining traffic patterns on 120`" Avenue throughout the <br />life of the mine. Use of this crossing of the Fulton Ditch will alter traffic patterns on the <br />internal 2.2-acre access driveway as shown by Exhibit C-1. <br />3. The amendment, if approved, will add approximately 5 acres of the 21-acre lake, owned <br />by the Henderson Water Ski Club, LLC, to M-2001-085. The Applicant intends to <br />remove approximately 5 feet of sand from the 5-acre area by a barge mounted suction <br />pump, which will pump the sand directly onto the already permitted area of the 124`" <br />Estates Sand and Gravel Mine. <br />Attached is a letter from Ground Engineering Consultants of October 29, 2003, which states <br />that neither dredging of the water ski lake, nor the proposed Ditch crossing, nor the continued <br />use of the internal access driveway has the potential to damage permanent man-made <br />structures within 200 feet. <br />The Fulton Irrigating Ditch Company has approved, in concept, the proposed new crossing of <br />the Ditch (see attached letter of May 13, 2003). The Ditch Company is requiring execution <br />of a formal Ditch Crossing Agreement, as well as opportunity to review and approve <br />engineering plans for the bridge. Attached is a letter from Tetra Tech RMC, the Ditch <br />Company's consultant, which recommends approval of a temporary Ditch Crossing that <br />includes provision for the 124'h Estates Partners to be responsible for damage to the Ditch and <br />surrounding easement area. <br />The agreement between the Applicant and the Henderson Water Ski Club, LLC, which is <br />referenced above, contains a provision that requires the Applicant to compensate the Ski Club <br />for damage to structures on its property. <br />Thank you for your attention to the application materials regarding the 124th Estates Sand and <br />Gravel Mine, which have been submitted to the Division. If you have further comments or <br />
